Kuasa Hukum pelapor A Sin, Dr (C) Anri Agam SH.MH. CPM. CPArb didampingi timnya Dr (C) Yusri Fachri SH.MH ketika memberikan keterangan kepada wartawan di depan gedung Ditreskrimum Poldasu, Selasa (14/1) siang.(jos tambunan).
MEDAN, INVOCVIT.COM – Kasus dugaan penggelapan asset perusahaan dan pemalsuan surat yang dilaporkan ke Polda Sumut oleh A Sin dua tahun lalu, hingga kini diduga sengaja diperlambat penyelidikannya oleh oknum penyidik pembantu unit Ranmor Subdit III/Jahtanras Ditreskrimum Poldasu.
Pasalnya, hingga saat ini terlapor Susanto Lian tidak pernah diperiksa. Bahkan, beberapa kali dilakukan pemanggilan terlapor selalu mangkir. Namun, upaya penyidik untuk melakukan penjemputan paksa tidak kunjung dilakukan.
Merasa kecewa dengan sikap oknum penyidik bernama Wiranta, kuasa hukum pelapor, Dr. (C). Andri Agam SH.MH. CPM. CPArb kembali mendatangi penyidik pembantu di unit Ranmor tersebut. Namun, kata Andri bahwa oknum penyidik pembantu Wiranta berjanji hari ini (Selasa 14/1/25 red) akan mengajukan kepada pimpinannya untuk pemanggilan Susanto Lian.
“Seharusnya penyidik menjemput paksa terlapor Susanto Lian mengingat sudah bolak-balik dipanggil tidak mau datang. Dalam hal ini seharusnya penyidik juga menerapkan pasal tambahan mangkir (pasal 224:1), jika saksi dipanggil mangkir bisa ditahan dengan ancaman hukuman 9 bulan penjara. Tapi itupun tidak dilakukan penyidik. Jadi kami patut menduga ada bergaining antara terlapor dengan oknum penyidiknya,” kata Andri Agam didampingi timnya Dr (C) Yusri Fachri SH.MH kepada wartawan di depan gedung Ditreskrimum seusai menemui oknum penyidiknya, Selasa (14/1/25).
Pengacara dari Kantor Hukum Law Firm Andri Agam SH.MH itu mengatakan, sudah beberapa kali bertemu dengan penyidik Wiranta mempertanyakan alasan penyidik tidak melakukan upaya paksa terhadap Susanto Lian. Namun, alasan penyidik bermacam-macam. ”Dia bilang belum bisa menjemput paksa Susanto Lian karena anggota sedang pengamanan Pilkada dan berjanji seusai Pilkada akan segera dijemput paksa. Namun ditanya lagi, oknum penyidiknya beralasan masih pengamanan Nataru. Kemudian, beliau bilang ada pergantian Pj Kasubdit dan terakhir, oknum penyidik itu mengatakan kalaupun Susanto Lian dijemput tidak bisa dilakukan penahanan hanya sebagai saksi dan baru bisa dilakukan penahanan setelah melihat hasil gelar perkara. Tapi, alasan tidak dapat dilakukan penahanan tidak disebutkan padahal Pasal 224 ayat (1) jelas diatur, saksi yang mangkir dalam beberapa panggilan dapat ditahan,” kata Andri Agam.
Sebagai penyidik yang profesional dan independent tanpa ada kepentingan, sebut Andri Agam, penyidik sudah seharusnya melakukan upaya paksa menghadirkan Susanto Lian untuk dimintai keterangannya. Kita tahu ada pasal jika saksi dipanggil mangkir ada diatur di Pasal 224 ayat (1), bisa dilakukan penahanan.
”Saya sampaikan kepada penyidiknya agar supaya menerapkan Pasal 224 ayat (1) KUHPidana karena beberapa kali mangkir dari panggilan. Tapi alasan penyidiknya, usulan penerapan pasal 224 ayat (1) itu akan mengkordinasikan dulu dengan pimpinan. Ini kan aneh, masa seorang penyidik harus melaporkan kepada pimpinan. Masa tidak tahu apa yang akan dilakukan. Dalam hal ini, muncul kecurigaan kalau kasus ini ada kepentingan oknum pejabat di Polda Sumut,” sebut Andri.
Andri mengaku heran sudah dipanggil beberapa kali namun terlapor tidak mau datang. Kita tidak tahu ini apakah ada indikasi atau seperti apa, kok sampai sekarang 2 tahun dipanggil tidak mau datang, Padahal sebagai warga negara yang baik polisi memanggil secara patut secara undang-undang wajib datang dan wajib dijemput dan sampai sekarang tidak ada mengkonfirmasi dan tidak ada niat untuk datang. Kami tidak tahu seperti apa penyidik ini. Kami merasa dibohongi, meras lambat. Dia mengaku sendiri proses ini berjalan lambat seperti kura-kura. Kami meminta pak Dir dan Kapolda untuk mengatensi kasus ini karena kerugian klien kami hampir Rp.50 milyar. Bahkan terlapor Susanto Lian masih di Medan.
Andri Agam juga mengaku heran dengan adanya istilah penyidik, ”Kalau di Jakarta sana mungkin banyak Capital, tapi kalau di Medan hanya satu Capital”, kita bisa berasumsi macam-macam, kita tidak pernah menyinggung Capital tapi kok oknum penyidiknya bisa bilang begitu,” ucapnya.
”Kami memberi waktu beberapa hari ini kepada penyidik untuk memanggil Susanto Lian. Tapi, jika janji penyidik tidak ditepati maka akan melaporkan oknum penyidik ke Propam dan menyurati Kapolri, Komisi III DPR RI, Kompolnas. Dan akan mendesak Ketua DPRD Sumut memanggil Kapoldasu Irjen Whisnu Hermawan Februanto untuk RDP (Rapat Dengar Pendapat).
Dia mengaku, melaporkan Susanto Lian dalam dua laporan polisi sesuai pasal 263 (Pemalsuan surat) dan pasal 374 yang dilaporkan tanggal 16 Desember 2022 dan tanggal 27 Desember 2022. Kronologis kasus, jelas Andri Agam, Susanto Lian dan A Sin ada mendirikan perusahaan PT.Tanindo Tetap Jaya di Deli Serdang yang bergerak dalam produksi pupuk jenis Phosfat, super phonskah, super phosfat dan lain-lain untuk pertanian dan perkebunan. Dalam perusahaan itu, A Sin menjabat sebagai komisaris.
Seiring berjalannya waktu, Susanto Lian diduga melakukan RUPS (Rapat Umum Pemegang Saham) yang tidak mengikutkan A Sin. Kemudian, terbit surat dari pengadilan yang mengatakan kalau perusahaan PT.Tanindo Tetap Jaya sudah pailit dan kemudian Susanto Lian diduga mendirikan perusahaan baru dengan produksi yang sama.
Merasa dikhianati, A Sin melaporkan Susanto Lian ke Polda Sumut namun laporannya di SP3 Subdit III/Jahtanras Ditreskrimum Poldasu.
”Kemudian, A Sin kembali melaporkan Susanto Lian dengan sangkaan Pasal 263 dan Pasal 374 KUHPidana. Pelapor, A Sin menduga ada menggelapkan uang perusahaan dan juga ada surat-surat yang dipalsukan untuk meminjam uang. Penyidik bahkan sudah memanggil pihak BRI untuk mengecek aliran dana dan memang benar uang sudah mengalir ke rekening yang bersangkutan tanpa sepengetahuan dari komisaris dan ini sudah memenuhi unsurnya,” jelas Andri.
Selain itu, tambah Dr (C) Anri Agam SH.MH, kliennya menduga kalau Susanto Lian ada menggelapkan barang. Yang mana, asset dari perusahaan terdahulu (PT.Tanindo Tetap Jaya) diduga dibawa Susanto Lian ke perusahaan dia yang baru didirikan (PT.Tanindo Subur Jaya).
Sementara itu, Dirreskrimum Poldasu Kombes Sumaryono dikonfirmasi alasan penyidik tidak melakukan upaya paksa terhadap terlapor Susanto Lian yang sudah bolak-balik dipanggil namun tidak mau datang, belum menjawab. (jos).
