PATUMBAK, INVOCAVIT.COM: Presiden RI, Prabowo Subianto, diminta untuk memberantas aksi mafia tanah (agraria) yang meresahkan masyarakat di wilayah Sumatera Utara.
Permintaan itu disampaikan kuasa hukum PT Sianjur Resort, Bambang Hendarto, kepada awak media di Kecamatan Patumbak, Desa Marindal II, Kabupaten Deliserdang, Rabu (17/12).
Ia mengatakan, lahan seluas 125 hektar yang berada di Kecamatan Patumbak, Desa Marindal II, Kabupaten Deliserdang, awalnya diklaim pihak PTPN II berada di area HGU 31 sehingga akan dilakukan eksekusi. Padahal di lahan itu sudah terbit tujuh SK Camat sejak tahun 2004.
“Pihak PTPN II mau mengajukan eksekusi di atas lahan kita, sementara berdasarkan Putusan PTUN yang sudah inkrah dinyatakan jika HGU 31 tidak berada diatas lahan PT. Sianjur Resort. Dan hari ini kami sedang melakukan upaya perlawanan eksekusi yang akan dilakukan PTPN II,” katanya.
Lebih lanjut, Bambang mengungkapkan pihak PTPN II bersama juru sita Pengadilan Negeri Lubuk Pakam melaksanakan konstatering yaitu tindakan hukum pencocokan atau verifikasi objek sengketa (biasanya tanah atau bangunan.
“Namun pelaksanaan konstatering yang diajukan pihak PTPN II selaku pemohon gagal terlaksana. Padahal kami selaku termohon menyatakan siap untuk digelarkan pencocokan lahan tersebut,” ungkapnya seraya mengaku kecewa karena penundaan pelaksanaan konstatering tersebut.
“Pada kesempatan ini untuk menjamin transparansi di bidang pertanahan, sudah ada aplikasi digital “Bhumi” dan Aplikasi “Sentuh Tanahku” milik kementerian ATR/BPNyg dapat di akses.
Sehingga dapat dilihat dengan jelas jika HGU 31 yg diklaim oleh PTPN II yg sekarang jadi PTPN I berlokasi di daerah Selambo dan tidak berlokasi di belakang Mapolda Sumut,” terang Bambang bahwa dirinya menduga dalam permasalahan sengketa lahan itu ada permainan mafia tanah.
Sementara itu Juru Sita Pengadilan Negeri (PN) Deli Serdang, Azhari Siregar mengatakan, kegiatan hari ini ada konstatering, pencocokan terhadap putusan seluas 125 hektare (ha).
Tapi, kenyataannya pada hari ini polisi belum siap karena ada kegiatan. Maka pelaksanaan (pencocokan) ditunda dalam waktu yang tidak ditentukan,” kata Azhari.
Ia menambahkan, penggugat lahan itu adalah pihak PTPN II, sedangkan tergugat PT Cianjur Resort, Polda Sumut, Kantor Pertanahan. “Kalau untuk objek itu kita belum tahu, karena kita belum melaksanakan konstatering. Tapi, sebagian menurut pemohon ini (lahan Polda Sumut),” pungkasnya.***
