MEDAN, INVOCAVIT.COM – Tiga Panitia Pemilihan Kecamatan (PPK) Medan Timur divonis Hakim tiga bulan penjara oleh Pengadilan Negeri (PN) Medan karena terbukti menggelembungkan suara Pileg 2024, Selasa( 21/5/2024)
Tiga PPK itu Abdilla Syadzaly Barrah Hutasuhut (25), Junaidi Machmud (48), dan Muhammad Rachwi Ritonga (28)
“Mengadili, menyatakan terdakwa terbukti secara sah dan meyakinkan bersalah melakukan tindak pidana turut serta secara sengaja menyebabkan peserta pada Pemilu mendapatkan penambahan suara sebagaimana dari dakwaan alternatif pertama,” kata Ketua Majelis Hakim, As’ad Rahim Lubis dalam amar putusannya, Selasa (21/5/2024).
“Menjatuhkan pidana terhadap terdakwa oleh karena itu dengan pidana penjara selama tiga bulan. Denda Rp25 juta dengan ketentuan apabila denda itu tidak dibayar diganti pidana kurungan satu bulan,” sambung As’ad Rahim Lubis.
Hakim menilai bahwasanya ketiganya terbukti melanggar Pasal 532 Jo Pasal 554 UU RI Nomor 7 Tahun 2017 Tentang Pemilihan Umum Jo Pasal 55 Ayat (1) Ke-1 KUHPidana sebagaimana dakwaan primair.
Adapun pertimbangan majelis hakim pada hal yang memberatkan adalah bahwa perbuatan tiga PPK itu bertentangan dengan Pemilu yang jujur dan adil sebagaimana pada undang undang Pemilu. Selain itu perbuatan mereka mencoreng nama baik pemilihan umum secara kelembagaan, dan ketiganya juga tidak mengakui perbuatan nya.
Vonis tiga bulan penjara yang dibacakan oleh ketua majelis hakim As’ad Rahim Lubis kepada tiga PPK yang melakukan penggelembungan suara di Pemilu 2024 itu jauh lebih rendah dari tuntutan Jaksa Penuntut Umum (JPU). Jaksa sebelumnya menuntut ketiganya agar dijatuhi hukuman pidana penjara selama satu tahun.
Untuk diketahui, l perkara ini berawal dari saat pelaksanaan pemilu 2024. Saat itu, ketiga terdakwa bertindak sebagai PPK.
Selanjutnya, pada tanggal 16 Februari 2024 hingga 1 Maret 2024 terdakwa Muhammad Rachwi Ritonga selaku Ketua PPK Medan Timur bersama kedua terdakwa lainnya bertugas melakukan penghitungan rekapitulasi suara pemilu 2024.
Di mana saat itu, ketiga terdakwa memperoleh data C Plano dari Kelompok Penyelenggara Pemungutan Suara (KPPS) melalui Panitia Pemungutan Suara (PPS), untuk suara Partai Kebangkitan Bangsa (PKB) di Kelurahan Glugur Darat I, Kelurahan Glugur Darat II, dan Kelurahan Pulo Brayan Darat I.
Kemudian, pada Sabtu (2/3/2024) para saksi dari partai yang menyaksikan perhitungan rekapitulasi suara meminta kepada ketiga terdakwa untuk segera memberikan data hasil perhitungan rekapitulasi suara yang dituangkan ke dalam D Hasil.
Namun, karena hasil perhitungan rekapitulasi suara belum selesai dilakukan, maka selanjutnya terdakwa Muhammad Rachwi Ritonga meminta terdakwa Abdilla Syadzaly Barrah Hutasuhut untuk memindahkan suara dari Partai Buruh dan Partai Kebangkitan Nusantara (PKN) ke Partai Kebangkitan Bangsa (PKB).
Kemudian, terdakwa Abdilla Syadzaly Barrah Hutasuhut atas persetujuan terdakwa Muhammad Rachwi Ritonga meminta kode Aplikasi Sirekap di tingkat kecamatan kepada terdakwa Junaidi Machmud beserta password dan kode OTP.
Setelah itu, terdakwa Abdilla Syadzaly Barrah Hutasuhut pun membuka Aplikasi Sirekap tersebut dan memindahkan suara dari Partai Buruh dan PKN ke PKB.
Di mana pada saat itu sedang berlangsung rekapitulasi suara untuk seluruh partai peserta pemilu pada tingkat Kecamatan yang dilakukan oleh seluruh anggota PPK dan dihadiri oleh para saksi yang diutus oleh partai peserta pemilu dengan sistem penghitungan suara atau rekapitulasi suara, yaitu dengan cara menayangkan C Plano dengan menggunakan alat proyektor.
Sementara, terdakwa Abdilla Syadzaly Barrah Hutasuhut menginput rekapitulasi suara ke dalam Microsoft Excel yang hasilnya akan dibagikan kepada para saksi dari partai peserta pemilu.
Setelah rekapitulasi suara selesai dilakukan oleh ketiga terdakwa, kemudian pada Sabtu (2/3/2024) saksi partai meminta hasil Berita Acara Penghitungan Suara atau D Hasil, karena belum finalisasi.
Sehingga, ketiga terdakwa memberikan dan membagikan rekapitulasi penghitungan suara dalam bentuk Microsoft Excel kepada para saksi peserta pemilu yang salah satunya adalah saksi dari PKB, Partai Gerindra, Partai Buruh, dan PKN.
Ternyata, hasil rekapitulasi suara yang dilakukan ketiga terdakwa terdapat perbedaan jumlah suara antara C Plano yang dibuat oleh KPPS dengan D Hasil yang dibuat oleh PPK Medan Timur.
Di mana hal tersebut dikarenakan adanya pemindahan suara dari PKN dan Partai Buruh ke PKB. Sehingga, PKB memperoleh tambahan suara dari kedua partai tersebut.
Selanjutnya, pada Senin (4/3/2024), PPK Medan Timur memberikan D Hasil kepada seluruh saksi partai yang ditandatangani oleh ketiga terdakwa dan para saksi peserta partai pemilu.
Kemudian, keesokan harinya tepatnya Selasa (5/3/2024), seluruh kotak dan surat suara beserta C Plano atau C Hasil dan juga D Hasil didistribusikan ke Komisi Pemilihan Umum (KPU) Medan dan pihak KPU Medan mengesahkan D Hasil yang dikeluarkan PPK Medan Timur dengan mekanisme Rapat Pleno.
Dihari yang sama, sekira pukul 05.00 WIB, saksi Sarmak Hasbi Sidqi Hasibuan sebagai Komisioner Panitia Pengawas Kecamatan (Panwascam) Medan Timur telah mengetahui adanya penggelembungan suara.
Keesokan harinya, pihak Badan Pengawas Pemilu (Bawaslu) Medan menerima informasi awal secara tertulis dari Pengacara Netty Yuniati Siregar yang merupakan Calon Legislatif (Caleg) Kota Medan dari Partai Gerindra terkait adanya penggelembungan suara.
Selanjutnya, Bawaslu Medan membuat laporan atau temuan adanya penggelembungan suara yang dilakukan tingkat PPK ke KPU Medan, akan tetapi tidak diindahkan setelah sampai penetapan pada tanggal 12 Maret 2024.
Kemudian, dengan adanya penambahan suara ke PKB, Netty Yuniati Siregar pun merasa dirugikan atas hal tersebut. Sehingga, jumlah suara yang diperoleh Partai Gerindra tidak masuk untuk mendapatkan kursi ke-12 sesuai dengan pembagian dari KPU Kota Medan.(red)
