Selain dia, sejumlah kades pun terpang-pang fotonya bersama Darwis Damanik yang disebut-sebut sebagai bakal Calon Bupati Labuhanbatu.
Abdi Jaya Pohan yang dihubungi wartawan belum memberikan keterangan atas fotonya yang berseliweran dimedia sosial. Ponsel yang keadaan aktif belum menjawab.
Berbeda dengan Horas Kepala Desa Pangkatan, ia menjelaskan bahwa foto itu dijepret pada bulan Mei tahun 2024.
Dia mengatakan, kehadiran mereka ke DPR-RI itu guna memberikan usulan kepada dewan untuk pembagunan desa di Labuhanbatu.
“Itu diruang fraksi DPR-RI, jadi yang mau kita temui bernama Martin Manurung anggota Dewan bukan dikantor Nasdem fotonya itu,” kata Horas, Senin (15/7/2024) saat dikonfirmasi wartawan melalui teleponnya.
Ia menjelaskan, penyambutan itu kebetulan yang menerima merupakan staf ahli Nasdem di DPR-RI yaitu Darwis Damanik.
“Murni itu membawa usulan desa dan bukan di fraksi itu saja kita bawakan, kalau yang hadir disitu berkisar empat orang Kades dari Labuhanbatu,” jelas Horas.
Horas menambahkan, dalam konteks Pilkada di Labuhanbatu ia tak mengenal bahwa Darwis Damanik itu maju sebagai Bakal Calon Bupati.
“Ngak tau aku dia bakal calon Bupati, yang kita tau dia staf ahli dari Martin Manurung yang merupakan anggota DPR-RI,” ujar Horas mengakhiri.
Menaggapi itu Edi Syahputra Ritonga,Spd selaku pemerhati Labuhanbatu mengigatkan agar Aparatur Sipil Negara (ASN) dan Kades dilarang memberi dukungan atau melakukan kegiatan yang mengarah pada politik praktis pada kontestasi Pilkada/Pilgub.
Katanya, netralitas ASN dan Kades merupakan hal yang perlu terus dijaga dan diawasi, agar Pemilu/Pemilihan dapat berjalan secara jujur (fairplay), demokrasi dan adil.
Itu merujuk, dalam UU Nomor 5 Tahun 2014 (UU ASN), UU Nomor 34 Tahun 2004 tentang Tentara Nasional Indonesia (UU TNI), dan TAP MPR RI Nomor VII/MPR/2000 tentang peran TNI Polri.
Selain ASN, juga telah diatur dalam peraturan larangan bagi para kepala desa beserta perangkat desa untuk tidak ikut dalam politik praktis yakni Kepala desa dan perangkat desa dilarang melakukan politik praktis yang regulasinya tertuang dalam Pasal 280, Pasal 282, dan Pasal 494 UU No. 7 Tahun 2017 tentang Pemilu.
Sanksi yang dikenakan jika aparatur desa terbukti melakukan politik praktis dapat berupa sanksi pidana penjara dan denda.
“Harapannya kepada para ASN, Kepala desa beserta jajarannya tidak terlibat politik praktis dan menjunjung tinggi peraturan yang berlaku tentang larangan bagi ASN dan Kepala Desa.
