Sidang lapangan yang dipimpin ketua majelis Endra Hermawan SH MH yang dihadiri kuasa hukum tergugat, Jumat (22/8).(ist).
Deli Serdang, INVOCAVIT.COM: Sidang lapangan sengketa kepemilikan lahan seluas 2,2 hektare di Dusun IV, Desa Deli Tua, Kecamatan Namorambe, Kabupaten Deli Serdang, pada Jumat (22/8), berjalan aman dan Lancar.
Sidang Lapangan itu dipimpin ketua majelis Endra Hermawan SH.MH bersama hakim anggota Abdul Wahab dan Dewi Andriyani, yang dihadiri kuasa hukum tergugat, Albert, yakni Dr (C) Andri Agam, SH MH.CPM.CPArb, Jumat (22/8).
Sidang lapangan digelar setelah usai dilakukan sidang pembuktian kepemilikan dari pihak tergugat (Albert) pekan lalu. Dalam sidang pembuktian dokumen kepemilikan lahan itu, kuasa hukum penggugat Muhammad Rafiq Hasibuan yakni Rudi Hasibuan SH menyerahkan surat pengunduran diri kepada ketua majelis.
“Berhubung surat kuasa telah dicabut penggugat maka dengan ini saya mundur,” demikian inti dari surat pengunduran Rudi Hasibuan SH yang diberikan kepada ketua majelis Endra Hermawan.
Dalam sidang lapangan itu, majelis hakim Endra Hermawan melakukan pengecekan langsung terhadap objek lahan yang disengketakan Berdasarkan dokumen pembuktian yang telah diajukan sebelumnya, tanah tersebut dinyatakan sesuai dengan kepemilikan atas nama Albert.
Hakim PN Lubuk Pakam menyatakan putusan kasus gugatan kepemilikan lahan ini akan dibacakan dalam waktu dua pekan mendatang.
Dalam kesempatan itu, kuasa hukum tergugat, Dr (C) Andri Agam SH.MH.CPM.CP Arb menyampaikan apresiasinya kepada hakim yang melihat obyek perkara melalui sidang lapangan. Dengan sidang lapangan ini diyakini hakim memutuskan jika lahan seluas 2,2 hektar itu benar adanya milik ahli waris Albert.
“Dalam persidangan pekan lalu bahwa kuasa hukum penggugat tidak mampu memperlihatkan bukti kepemilikan kepada hakim sehingga dia mundur. Ini membuktikan kalau lahan ini milik klien saya (Albert),” kata Andri Agam.
Andri menambahkan, mulai dari proses persidangan hingga sampai agenda pembuktian dari penggugat bahwa para pihak dari penggugat tidak pernah hadir.
MENGAKU AHLI WARIS
Sebelum sidang lapangan dimulai dan majelis hakim belum dilokasi, tiga wanita yang mengaku ahli waris datang kelokasi. Mereka sempat mengaku sebagai ahli waris namun tidak membawa bukti kepemilikan.
Seorang saksi bernama Selamat yang semula berpihak kepada Muh Rafiq Hasibuan termasuk ketiga wanita itu sempat adu mulut. Namun, Selamat dengan tegas mengatakan jika Muh Rafiq Hasibuan dkk tidak memiliki alas hak asli.
“Saya awalnya memihak kepada Muh Rafiq Hasibuan namun saya justru menjadi korban penipuan dari Muh Rafiq Hasibuan. Saya masuk penjara gara-gara kalian. Namun ketika saya masuk penjara, kalian tidak satu orangpun yang mau membantu bahkan kalian biarkan saya dipenjara termasuk pengacara Rudi Hasibuan yang ditunjuk Muh Rafiq Hasibuan mendampingi saya,” teriak Selamat.
Selamat juga mengatakan, dirinya masuk penjara karena Muh Rafiq Hasibuan mengaku sebagai ahli waris pemilik tanah dan disuruh untuk merusak pagar yang dibangun ahli waris yang sah, Albert. Ternyata Muh Rafiq Hasibuan hanya memiliki surat Poto kopi.
“Kalau kalian punya surat asli kenapa tidak mau memperlihatkan kepada polisi dan di pengadilan. Jadi kalian jangan bilang sebagai ahli waris jika tidak mampu memperlihatkan surat yang asli,” tegas Selamat.
Diketahui, Selamat dan Sumardi alias Mondo terpaksa mendekam di Lapas Pancurbatu setelah divonis 4 bulan penjara ditambah 2 bulan banding. Mereka ditahan karena merusak pagar.
Bukan hanya masuk penjara, keduanya mengaku harus mengeluarkan biaya sendiri untuk keperluan sehari-hari bahkan ditipu sebesar Rp.20.2000.000 oleh pengacara Rudi Hasibuan.
Rudi Hasibuan, sebut Selamat dan Mondo, meminta uang untuk hakim, jaksa dan biaya selama dipersidangan dengan iming-imingi langsung bebas. Akan tetapi, keduanya justru divonis 4 bulan ditambah 2 bulan. Bahkan, setelah mereka mendekam di Lapas, pengacara Rudi Hasibuan memblokir hp agar supaya tidak dapat dihubungi.(jos).
