Jakarta, INVOCAVIT.COM : Komisi Pemberantasan Korupsi (KPK) menetapkan lima tersangka dan melakukan penahanan, dalam kasus dugaan korupsi terkait proyek pembangunan serta preservasi jalan di wilayah Sumatera Utara (Sumut). Kelima tersangka ditahan di Rutan Cabang KPK Gedung Merah Putih selama 20 hari ke depan .
Plt. Deputi Penindakan dan Eksekusi KPK Asep Guntur Rahayu menyebut bahwa terdapat dua tersangka dari proyek yang dijalankan Dinas Pekerjaan Umum dan Perumahan Rakyat (PUPR) Provinsi Sumatera Utara (Sumut).
“Satu, TOP selaku Kepala Dinas PUPR Provinsi Sumut. Dua, RES selaku Kepala UPTD Gunung Tua Dinas PUPR Provinsi Sumut merangkap pejabat pembuat komitmen (PPK),” katanya dalam konferensi pers di Gedung KPK, Jakarta, Sabtu (28/6).
Lalu, satu tersangka berinisial HEL dari proyek yang dilaksanakan Satuan Kerja (Satker) Pembangunan Jalan Nasional (PJN) Wilayah 1 Sumut.
Kemudian, dua tersangka dari pihak swasta yang berinisial KIR selaku Direktur Utama PT DNG dan RAY selaku Direktur PT RN.
“RAY ini adalah anak dari KIR,” kata Asep.
Kelima tersangka tersebut diamankan dalam operasi tangkap tangan (OTT) pada Kamis (26/6) malam atas dugaan tindak pidana korupsi dalam upaya memuluskan proyek dengan total senilai Rp231,8 miliar.
Asep menerangkan, pada Dinas PUPR Provinsi Sumut, tersangka TOP selaku Kadis PUPR Sumut memerintahkan tersangka RES untuk menunjuk KIR selaku Dirut PT DGN sebagai rekanan tanpa melalui mekanisme dan ketentuan pada proyek pembangunan Jalan Sipiongot Batas Labusel dan proyek pembangunan Jalan Hutaimbaru-Sipiongot, dengan total nilai proyek sebesar Rp157,8 miliar.
“Di sini sudah terlihat perbuatan bahwa ada kecurangan. Seharusnya ini melalui proses lelang yang benar-benar transparan,” katanya.
Selain itu, tersangka KIR bersama RES bersama-sama mengatur proses e-catalog agar PT DGN dapat memenangkan proyek pembangunan Jalan Spiongot Batas Labusel.
“Atas pengaturan proses e-catalog di Dinas PUPR Pemprov Sumut tersebut, terdapat pemberian uang dari KIR dan RAY untuk RES yang dilakukan melalui transfer rekening,” imbuhnya.
Sementara itu, pada Satker PJN Wilayah 1 Sumut, tersangka HEL selaku PPK Satker PJN Wilayah 1 Sumut merupakan penyelenggara negara yang bertanggung jawab, antara lain menandatangani dan mengendalikan pelaksanaan kontrak pengadaan serta mengambil keputusan yang dapat mengakibatkan pengeluaran anggaran belanja.
Adapun PT DGN yang dipimpin oleh tersangka KIR dan PT RN yang dipimpin oleh RAY telah mendapatkan beberapa pekerjaan preservasi dan rehabilitasi jalan di wilayah Sumut sejak tahun 2023 hingga saat ini.
“Bahwa HEL karena jabatannya selaku Satker PJN Wilayah I Provinsi Sumut telah menerima sejumlah uang dari KIR dan RAY sebesar Rp120 juta dalam kurun waktu Maret 2024–Juni 2025,” kata Asep.
Penerimaan uang itu, lanjut dia, karena HEL telah melakukan pengaturan proses e-catalog sehingga PT DGN dan PT RN terpilih sebagai pelaksana.
Dilanjutkan Asep, barang bukti yang disita dalam OTT adalah uang senilai Rp231 juta yang diduga merupakan sisa pembayaran proyek.
Tersangka KIR dan RAY disangkakan telah melanggar Pasal 5 ayat (1) huruf a atau b atau Pasal 13 Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi juncto Pasal 55 ayat (1) ke-1 KUHP.
Sedangkan tersangka TOP, RES, dan HEL disangkakan telah melanggar Pasal 12 huruf a atau b, Pasal 11, atau 12B Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi juncto Pasal 55 ayat (1) ke-1 KUHP.(ant).
