Polda Sumut Sidik Dugaan Korupsi Bank Mandiri

MEDAN, INVOCAVIT.COM –
Penyidik Subdit III/Tipidkor Direktorat (Dit) Reskrimsus Polda Sumut tengah melakukan penyidikan terhadap kasus dugaan korupsi bernilai miliar rupiah di Bank Mandiri.

“Kasusnya sudah tahap penyidikan,” terang Plt Kabid Humas Polda Sumut, Kombes Pol Yudhi Surya Markus Pinem melalui Kasubbid Penmas, Kompol Siti Rohani, Rabu (5/3/2025).

Kata Siti, penyidik telah memintai keterangan sejumlah saksi dalam kasus itu, namun belum menetapkan tersangka.

“Belum ada tersangka, masih pemeriksaan saksi-saksi,” ujarnya.

Diungkapkannya, penyidik kini tengah menunggu hasil audit dari Badan Pengawasan Keuangan dan Pembangunan (BPKP) Sumut mengetahui kerugian negara.

“Saat ini masih menunggu perhitungan kerugian negara dari auditur BPKP,” pungkasnya.

Marudut Simanjuntak, SH, MH, MBA selalu Kurator PT Bintang Persada Satelit (BPSAT) menyebut, PT BPSAT, telah diputus pailit oleh Pengadilan Niaga Medan pada 1 Februari 2024, sebagaimana putusan Pengadilan Niaga pada Pengadilan Negeri Medan Nomor 8/Pdt.Sus-Pembatalan Perdamaian/2023/PN Niaga Mdn Jo Nomor 2/Pdt.Sus-PKPU/2022/PN Niaga Mdn, karena tidak mampu membayar utangnya.

Salah satu kreditur BPSAT adalah Bank Mandiri cabang Imam Bonjol Medan, dengan total piutang Rp 82.390.540.675,63, atas jaminan pabrik yang terletak di Jalan Ladang Gang Perdamaian No 34, Kelurahan Kedai Durian, Kecamatan Medan Johor, Kota Medan, Provinsi Sumatera Utara.

Namun, ternyata harta jaminan PT BPSAT di Bank Mandiri hanya senilai Rp 10 miliar, sesuai hasil penjualan lelang yang dilakukan pada tanggal 12 Februari 2024.

Sedangkan saat lelang tersebut, PT. BPSAT sudah dinyatakan pailit, yang sesuai ketentuan UU No. 37 Tahun 2004 tentang Kepailitan dan PKPU, harta debitur tersebut menjadi hak kurator untuk menjualnya.

PL selaku pemenang lelang atas pabrik PT BPSAT, telah menjual pula aset jaminan kepada pihak ketiga dengan nilai Rp. 17 miliar, dengan jarak hanya 2 bulan sejak membeli lelang

“Ada apa dengan Bank Mandiri, PL dan Su selaku Direktur PT BPSAT,” ujar Marudut melalui telepon seluler, Rabu (5/3/2025).

Penggelapan atas harta jaminan oleh Bank Mandiri, PL dan Su telah berpotensi menimbulkan kerugian negara lebih dari Rp 30 miliar, sebagaimana hasil penilaian dari BPKP Medan,

Marudut Simanjuntak, SH, MH, MBA selalu Kurator PT. BPSAT ketika dikonfirmasi mengatakan, kurator sedang berjuang, mempertahankan hak atas harta pailit dengan telah mengajukan pembatalan lelang ke pengadilan Niaga Medan, yang melalui putusan Nomor 2/Pdt.Sus-Gugatan Lain-lain/2024/PN Niaga Mdn Jo Nomor 8/Pdt.Sus-Pembatalan Perdamaian/2023/PN Niaga Mdn Jo Nomor 2/Pdt.Sus-PKPU/2022/PN Niaga Mdn tertanggal 19 Juli 2024, telah membatalkan lelang tersebut, namun Bank Mandiri saat ini sedang upaya kasasi.

Marudut meminta, hakim Mahkamah Agung dapat melihat kasus ini dengan bijak, baik dan menurut hukum, untuk menolak permohonan kasasi Bank Mandiri, agar ada hasil penjualan lelang aset pabrik dibagi kepada hak-hak pekerja yang belum dibayar, serta utang pajak ke negara yang mencapai Rp 9 miliar, sebab sesungguhnya perbuatan lelang bank mandiri adalah perbuatan cacat hukum.***
