MEDAN, INVOCAVIT.COM: Hans Silalahi SH selaku kuasa hukum Ny. Mimi Herlina Nasution, protes keras dan mempertanyakan kapasitas Tjong Budi Priyanto untuk pengukuran objek tanah di Jalan Sei Belutu No.62 Tanjung Rejo, Medan Sunggal.
“Stop. Tunggu dulu. Apa kapasitas Tjong Budi Priyanto ditunjuk untuk pengukuran objek lahan ini. Sementara, dalam sertifikat Sertifikat Hak Milik (SHM) Nomor 509, 510, dan 871 atas nama Alimin. Alimun, tidak memiliki alas hak. Bahkan, laporan Alimin sudah di-SP3 Ditreskrimum Polda Sumut pada 9 November 2022 sesuai surat ketetapan nomor 1889 b/XI/2022,” kata Hans, Jum’at (29/8/2025).
Hal itu ditegaskan Hans Silalahi SH, saat Kanit IV Subdit II Ditreskrimum Poldasu Kompol Jhonson M Sitompul SH MH hendak melakukan penyidikan awal dengan melakukan pengukuran objek lahan dengan menghadirkan pelapor Tjong Budi Priyanto, terlapor Ny. Mimi Herlina Nasution, Ahli Waris, BPN Sumut, KPKNL, Lurah dan Kepling.
Kompol Jhonson M Sitompul SH MH sejak awal menjelaskan bahwa pengukuran ini merupakan langkah awal penyidikan. “Jadi tidak perlu ada perdebatan. Tapi kita serahkan penanganannya pada ahlinya BPN Sumut, KPKLN disaksikan Lurah, Kepling dan disaksikan para pihak,” ujarnya.
Menurutnya, pihaknya selalu merespon laporan masyarakat. Tetapi soal benar dan tidaknya, perlu pendalaman.
Akhirnya Kuasa Hukum Ny. Mimi mempersilahkan pengukuran dilanjutkan dengan catatan, pihaknya telah menyampaikan fakta dan proses hukum yang sudah dilakukan.
Tahap pertama, Tjong Budi Priyanto menunjukkan batas lahan kepada pihak BPN Sumut, KPKLN, Lurah, Kepling dan pihak Ditreskrimum Poldasu.
Menurut Tjong Budi Priyanto, dirinya ikut inves 50 persen dalam pembelian objek lahan SHM No.509, 510 dan 871.
Pada tahap kedua, giliran Ny Mimi, ahli waris, BPN Sumut, KPKLN, Lurah, Kepling, kuasa hukum dan pihak Ditreskrimum Poldasu, melakukan pengukuran objek lahan sesuai legalitas kepemilikan.
Kuasa hukum Ny. Mimi, Khilda Handayani SH.MH menyatakan, bahwa kliennya Ny Mimi menguasai lahan (menempati). Sementara Alimin yang mengaku memiliki SHM, tidak memiliki alas hak dan warkah serta sama sekali tidak pernah menyentuh objek lahan.
Sementara Kepling Hanafi menyatakan, dirinya sejak tahun 2011, tidak pernah didatangi terkait jual beli tanah. Tapi, dirinya pernah menandatangani surat sita dari KPLN.
Hal itu dikuatkan oleh Tri Priyandi dari KPKLN. “Sebenarnya kami tidak terkait dalam masalah ini. Karena tugas kami sudah selesai. Kami pernah menyita lahan ini dan tahun 2021, pihak Ny Mimi telah melunasinya dan kami telah menyerahkan lahan ini pada Ny. Mimi. Dan kami hadir atas undangan pihak penyidik Poldasu untuk pengukuran,” ujarnya.
Hal yang sama juga dikatakan Diardo Saragih dari BPN Sumut, bahwa kehadirannya atas undangan Poldasu untuk melakukan pengukuran koordinat berdasarkan alas hak para pihak.
Di tempat yang sama Hans Silalahi SH MH selaku kuasa hukum Ny Mimi, akan melaporkan balik Tjong Budi Priyanto ke Poldasu.
“Mengingat bahwa sebelumnya pihak BPN telah mengukur obhek lahan. Dan Alimin, tidak memiliki titik koordinat dan tidak memiliki warkah. Jadi kami minta pihak penyidik bertidak tegas sesuai hukum dan pengukuran ini tidak sah,” ujarnya.
