INVOCAVIT.COM, JAKARTA – Polri bakal menggelar Sidang Komisi Kode Etik Polri (KKEP) Banding Irjen Pol. Ferdy Sambo pada hari Senin (19/9), pukul 10.00 WIB, di Divisi Propam Gedung TNCC Mabes Polri, Jakarta Selatan.
“(Sidang KKEP Banding FS) Senin besok, pukul 10.00 WIB,” kata Kepala Divisi Humas Polri Irjen Pol. Dedi Prasetyo (poto) kepada ANTARA saat dikonfirmasi di Jakarta, Minggu malam.
Dedi menyebutkan Sidang KKEP Banding atas nama Irjen Pol. Ferdy Sambo bakal dipimpin oleh perwira tinggi (pati) pangkat jenderal bintang tiga. Namun, ia belum menyebutkan rincian nama pimpinan sidang banding tersebut. Hal ini sebagaimana diatur dalam Pasal 75 ayat (1) Peraturan Polri Nomor 7 Tahun 2022 tentang Kode etik Profesi dan Komisi Etik Polri.
Sebelumnya, pada Kamis (15/9), Kapolri Jenderal Pol. Listyo Sigit Prabowo mengesahkan KKEP Banding untuk Ferdy Sambo.
Pelaksanaan sidang banding, kata Dedi, tidak seperti Sidang KKEP yang sebelumnya pernah digelar. Hanya berupa rapat antara Komisi Sidang Banding yang dipimpin perwira tinggi jenderal bintang tiga.
“Sidang banding jangan disamakan dengan sidang kode etik yang seperti lalu. Sidang banding sifatnya hanya rapat, dari hasil rapat itu nanti memutuskan kolektif kolegial apa keputusannya menguatkan dalam hal ini menerima atau menolak (banding),” kata Dedi, Kamis (15/9).
Diketahui Irjen Pol. Ferdy Sambo, tersangka kasus pembunuhan berencana Brigadir Nofriansyah Yosua Hutabarat atau Brigadir J dan menghalangi penyidikan (“obstruction of justice”) menjalani sidang etik pada Kamis (25/8).
Pimpinan Komisi Sidang KKEP memutuskan Pemberhentikan Tidak Dengan Hormat (PTDH) Irjen Pol. Ferdy Sambo karena terbukti secara sah dan meyakinkan melanggar Pasal 13 ayat 1 Peraturan Pemerintah Nomor 1 Tahun 2003 tentang Pemberhentian Anggota Polri juncto Pasal 5 ayat (1) huruf b, juncto Pasal 8 huruf b juncto Pasal 8 huruf c angka 1 juncto Pasal 10 ayat (1) huruf f juncto Pasal 11 ayat (1) huruf a, juncto Pasal 11 ayat (1) huruf b junto Pasal 13 huruf m Peraturan Polri Nomor 7 Tahun 2022 tentang Kode etik Profesi dan Komisi Etik Polri.
Atas putusan tersebut, Ferdy Sambo menyatakan banding sesuai haknya sebagaimana diatur dalam Pasal 69 Perpol Nomor 7 Tahun 2022.
Ferdy Sambo ditetapkan sebagai tersangka pembunuhan berencana Brigadir Nofriansyah Yosua Hutabarat atau Brigadir J yang dijerat dengan Pasal 340 subsider Pasal 338 juncto Pasal 55 dan Pasal 56 KUHP ancaman hukuman maksimal mati atau pidana penjara seumur hidup atau paling lama 20 tahun.
Mantan Kadiv Propam Polri itu juga dijadikan tersangka kasus menghalangi penegakan hukum pada penyidikan kasus Brigadir J dijerat dengan Pasal 49 juncto Pasal 33 dan/atau Pasal 48 Ayat (1) juncto Pasal 32 Ayat (1) Undang-Undang tentang Informasi dan Transaksi Elektronik (ITE) dan Pasal 221 Ayat (1) ke-2 dan/atau 233 KUHP juncto Pasal 55 KUHP dan atau Pasal 56 KUHP.(ant)
