Invocavit.com, Stabat – Jaksa Penuntut Umum (JPU) dari Kejari Langkat Baron Sidik menyebut, pembelaan (Pledoi) terdakwa TU, JS, SP dan RG terkesan berlawanan (kontradiktif). JPU menilai, Pasal 10 UU Nomor 21 Tahun 2007 tentang TPPO yang disangkakan kepada terdakwa sudah tepat. Mereka tetap kukuh atas tuntutannya kepada para pesakitan itu.
Pernyataan itu disampaikan JPU di persidangan yang digelar di Ruang Prof Dr Kusumah Admadja SH PN Stabat, Jum’at (25/11/2022) pagi. Saat membacakan tanggapan atas pledoi (replik) terdakwa, Baron menyebutkan, perbuatan terdakwa sudah memenuhi unsur dari pasal tersebut.
“Maka dari itu, kami jaksa penuntut umum tetap pada kesimpulan, atau ketetapan dalam tunttutan yang telah disampaikan pada persidangan sebelumnya,’ kata Baron saat membacakan nota replik.
Dalam pledoi sebelumnya, terdakwa bermohon agar terdakwa dibebaskan dari segala dakwaan, atau setidaknya melepaskannya dari segala tuntutan hukum. JPU menilai, permohonan itu sangat bertentangan dengan dakwaan. Karena JPU menganggap, para terdakwa sudah memenuhi unsur pidana TPPO.
Usai JPU menyampaikan replik dalam perkara 468/Pid.B/2022/PN.Stb itu, Ketua Majelis Hakim Halida Rahardhini SH MHum pun menutup persidangan. Agenda berikutnya, hakim akan membacakan putusannya (vonis), Senin (28/11/2022) mendatang.
Terpisah, Mangapul Silalahi yang merupakan penasihat hukum (PH) para terdakwa berharap, agar majelis hakim dapat memberikan putusan yang seadil – adilnya. Putusan nantinya diharapkan tanpa ada pengaruh dari apa pun.
“Penerapan pasal ini kepada terdakwa tidak tepat. Tidak ada perekrutan di sana, tidak ada jual beli, apa lagi perdagangan. Semua atas inisiatif keluarga korban,” terang Mangapul.
Diinformasikan, para terdakwa DP, HS, IS dan HS dituntut 3 tahun penjara terkait kematian Sarianto dan Bedul di panti rehab dekat kediaman TRP. Mereka didakwa dengan Pasal 170 ayat 2 ke-3 KUHP dan Pasal 351 ayat 3 Jo Pasal 55 ayat 1 ke-1 KUHP. (Ahmad)
