Jakarta, INVOCAVIT.COM : Konstitusi adalah sumber hukum yang tertinggi, demikian disampaikan Ketua MPR RI Ahmad Muzani dalam sambutannya di hari Konstitusi, yang dihadiri sejumlah tokoh peringatan Hari Konstitusi RI di antaranya Anggota DPR Edhie Baskoro Yudhoyono dari Fraksi Partai Demokrat, Menag RI Nasaruddin Umar, Ketua DPR Puan Maharani, Menteri Pembangunan Manusia dan Kebudayaan Pratikno, mewakili presiden Prabow Subianto, Senin (18/8) di MPR RI Jakarta.
Menurutnya di tengah perjalanan bangsa ini, kita tidak
boleh lengah. Karena kita sering dihadapkan pada godaan untuk mengabaikan konstitusi kita.
Sikap ini muncul, ketika norma-norma luhur konstitusi direduksi hanya menjadi formalitas belaka. Dinamika konstitusi Indonesia membawa pelajaran berharga yang penuh dilema.
Di satu sisi, ia mencerminkan komitmen kita pada nilai-nilai perjuangan kebangsaan dan gagasan ideal untuk mewujudkan negara bangsa yang modern.

Ini adalah ancaman nyata. Sikap ini akan menggerogoti sendi-sendi negara kita, merusak tatanan hukum, dan pada akhirnya, menghancurkan cita-cita luhur bangsa.
Untuk menghadapi ancaman ini, kita tidak bisa berdiam diri. Di sinilah Majelis Permusyawaratan Rakyat memiliki peran strategis.
MPR adalah benteng terakhir penjaga konstitusi. MPR harus memastikan bahwa Undang Undang Dasar Negara Republik Indonesia Tahun 1945, tetap utuh, relevan, dan menjadi pedoman
tertinggi bagi seluruh rakyat Indonesia.
MPR memastikan bahwa janji kemerdekaan tetap terwujud dalam keadilan, kemakmuran, persatuan, dan kedaulatan yang sejati.
Kewenangan ini adalah “mata” dan “telinga” MPR dalam melihat bagaimana konstitusi kita diterapkan. MPR perlu mengkaji secara cermat.
Bagaimana memastikan setiap produk hukum, dari undang-undang hingga peraturan daerah, tidak bertentangan dengan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945?
Dengan kajian yang objektif dan mendalam, MPR diharapkan dapat mencegah lahirnya kebijakan yang berpotensi merusak tatanan hukum dan semangat konstitusi.
Selain mengkaji sistem ketatanegaraan, MPR juga memiliki kewenangan untuk menyusun dan menetapkan perubahan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Ini adalah kewenangan yang luar biasa.
Ibarat seorang arsitek, MPR memegang tanggung jawab untuk memastikan “rumah” kebangsaan kita tetap kokoh dan relevan.
Namun, kewenangan ini harus digunakan dengan sangat hati-hati dan bijaksana. Amandemen bukanlah solusi instan untuk setiap
masalah. Ia harus melalui proses.
Transparan: Masyarakat harus mengetahui setiap langkah dan alasan di balik usulan perubahan. Partisipatif: Seluruh elemen bangsa, dari akademisi, tokoh masyarakat, hingga rakyat
biasa, harus dilibatkan.
Berdasarkan Konsensus yang Luas, Perubahan UUD NRI Tahun 1945 tidak boleh didasarkan pada keinginan segelintir kelompok, melainkan harus mencerminkan kesepakatan semua elemen bangsa.
Hari Konstitusi adalah pengingat bagi kita semua. Bahwa tugas menjaga konstitusi adalah tugas kolektif. Konstitusi bukanlah milik
sekelompok orang, melainkan milik kita semua. Mari kita gunakan setiap kewenangan yang kita miliki, baik melalui pengkajian, sosialisasi, maupun perumusan kebijakan, untuk memastikan bahwa konstitusi tetap tegak dan tidak tergoyahkan.
