4. Adanya rangkap jabatan dalam susunan pemerintahan Desa Mbaruai, dimana suaminya sebagai Perangkat Desa dan istrinya sebagai Anggota BPD, juga ada Anggota BPD yang merangkap sebagai Kader.
5. Kepala Desa Mbaruai diduga tidak ada melakukan musyawarah kepada kepala dusun ataupun Perangkat Desa untuk penerima BLT dana Desa tahun 2024.
6. Penyaluran Bantuan Pangan Non Tunai (BPNT) yang tidak sesuai/ tepat sasaran.
7. Desa Mbaruai berdasarkan Surat Keputusan (SK) Bupati Deli Serdang telah ditetapkan sebagai Desa ikan. Dimana Desa Mbaruai menjadi penghasil ikan mas terbesar di Kecamatan Biru Biru, tetapi saat ini yang terjadi beberapa area kolam perikanan sudah ditanami kelapa sawit oleh beberapa masyarakat.
8. Terdapat anggota BPD yang senyatanya tidak melakukan kewajibannya sebagaimana mestinya anggota BPD. Dalam hal tidak mengikuti rapat, tidak mengetahui Pembangunan Desa, serta mengabaikan keluhan/keberatan masyarakat.
9. Kepala Desa Mbaruai diduga melakukan pemotongan gaji Perangkat Desa pada bulan Januari 2024 sebesar Rp 500.000 dikarenakan SILPA Desa Mbaruai belum bisa dicairkan. Sementara Bendahara Desa sudah mengambil uang SILPA tersebut ke Bank.
10. Diduga adanya penyelewengan Dana Desa untuk pembangunan paving blok jalan tani di Dusun 1 Kepala Gajah mulai dari penimbunan tahun 2022 sampai lanjutan pemasangan paving blok di tahun 2024.
11. Diduga adanya penyelewengan Dana Desa untuk pembangunan paving blok jalan ke Dusun 3 Namo Rindang yang sebelumnya sudah di aspal beton kemudian dilanjutkan pemasangan paving blok.
12. Diduga adanya penyelewangan Dana Desa untuk pemasangan paving blok jalan ke sawah di Dusun II Mbaruai Tahun 2023 dimana sumber dana yang informasinya berasal dari sumbangan salah satu Calon Legislatif, yang kami menduga juga bersamaan adanya dikeluarkan dari dana Desa.
13. Diduga adanya penyelewangan Dana Desa Pembangunan paving blok jalan ke pancur di Dusun II Mbaruai. Dimana ukuran lebar paving blok dari depan ke belakang tidak sama(berbeda) dan adanya keberaatan masyarakat untuk pelepasan lahan tersebut tetapi diabaikan oleh TPK dan Kepala Desa.
14. Diduga adanya penyelewangan Dana Desa pada pembangunan paving blok sambungan jalan pemungkiman warga di Dusun IV Suka Rakyat tahun 2024.
15. Diduga adanya penyelewangan Dana Desa untuk pembangunan paving blok jalan ke ladang di Dusun IV Suka Rakyat Tahun 2022.
16. Dugaan adanya penyelewengan Dana Desa untuk Pembangunan Rapat Beton jalan Sawah Dusun II Mbaruai serta diduga tidak ada pembebasan lahan yang dilakukan.
17. Telah diresmikannya jembatan gantung di Dusun II Mbaruai, tetapi tidak ada akses jalan utama masyarakat menuju jembatan tersebut.
18. Diduga adanya pemotongan pajak pembangunan sekitar 30% untuk pembangunan di Dusun 1 Kepala Gajah dan Dusun IV Suka Rakyat Desa Mbaruai.
19. Selama Evinora Br Sitepu menjabat sebagai Kasi Pemerintahan Desa Mbaruai mulai Tahun 2022 sampai Juli 2024 Kepala Desa Mbaruai tidak pernah memberikan dana untuk Tim Pelaksanaan Tugas (TPK) sebagaimana tugas dan fungsinya sebagai kasi pemerintahan.
Warga bernama E br Sitepu menambahkan ada banyak kejanggalan dalam proyek. Diantaranya berada di Dusun III.
“Diduga adanya penyelewengan Dana Desa untuk pembangunan paving blok jalan ke Dusun 3 Namo Rindang yang sebelumnya sudah di aspal beton kemudian dilanjutkan pemasangan paving blok,” katanya, Sabtu (5/7/2025).
Selain itu, menurut sepengetahuan warga, Jalan itu merupakan jalan Kabupaten, tapi di bangun dengan menggunakan dana desa.
“Inilah yang mau kami tegaskan. Kepala desa tidak transparan terkait dengan sejumlah proyek yang ada di Desa Mbaruai. Dugaan kami negara dirugikan atas proyek di desa ini,” terangnya.
Terakhir, Karang Taruna Kecamatan Biru Biru, Rahmat Tarigan mengatakan agar Inspektorat dan Polresta Deli Serdang bekerja dengan maksimal.
“Pihak Tipikor Polresta Deli Serdang dan Inspektorat harus turun memeriksa Kades Mbaruai Effendi Ginting,” tuturnya.
Rahmat mengaku mereka sudah diundang DPRD Deli Serdang. Disitu warna terlihat kesal dan kecewa dan meminta agar kepala desa di tindak tegas jika terbukti melakukan korupsi.
