Dalam amar putusannya, Majelis Hakim menyatakan terdakwa Nanda terbukti melanggar Pasal 114 ayat (2) UU RI No. 35 Tahun 2009 Tentang Narkotika.
Menurut hakim, hal memberatkan, perbuatan terdakwa tidak mengikuti program pemerintah dalam pemberantasan peredaran narkotika
“Tidak ditemukan hal meringankan pada diri terdakwa,” ucap hakim.
Menyikapi putusan tersebut, lanjut hakim, diberikan waktu 7 hari kepada terdakwa melalui Penasihat Hukumnya (PH) maupun Jaksa Penuntut Umum (JPU) untuk mengajukan permohonan banding atau menerima putusan. Sebelumnya Jaksa Maria Tarigan dari Kejati Sumut menuntut Nanda 14 tahun penjara
Diketahui, perkara ini berawal Sabtu tanggal 18 Februari 2023 sekira pukul 00.10 WIB di Jalan Mangaan I Lingkungan IV, Kelurahan Mabar Hilir, Kecamatan Medan Deli, Kota Medan saat terdakwa ditangkap Petugas Polisi BNNP Sumut
Jumat tanggal 17 Februari 2023 sekira pukul 14.00 WIB terdakwa dihubungi Asun melalui handphone memerintahkan terdakwa untuk mengambil bahan atau sabu sebanyak satu kilogram
Selanjutnya sekira 16.00 WIB terdakwa diperintahkan Asun menuju lokasi pengambilan bahan atau sabu sesuai arahan Kasim di Marelan Pasar Lima di lapangan adapun narkotika tersebut sudah diletakan dibawah pohon besar sebanyak satu kilogram sabu
Pada pukul 19.00 WIB terdakwa diperintahkan Asun untuk memindahkan sabu tersebut ke rumah terdakwa di Jalan Islamiyah No 35, Kelurahan Mabar Hilir, Kecamatan Medan Deli, Kota Medan.
Barang bukti yang disita dari terdakwa satu buah Handphone Merk OPPO Warna Merah, satu bungkus berisikan kristal bening diduga narkotika jenis sabu yang dibungkus teh berwarna hijau bertuliskan Guanyinwang dengan berat bruto 1034,4 gram adalah milik dari Asun yang di sita dari terdakwa di rumah terdakwa
Lalu, satu bungkus berisikan Kristal bening diduga narkotika jenis sabu yang di bungkus plastik bening dengan berat bruto 95,4 gram dan satu buah timbangan adalah milik dari Asun disita dari terdakwa di rumahnya. 30 plastik klip ukuran sedang dan 30 plastik klip ukuran kecil disita adalah milik dari Asun dari terdakwa di rumahnya.(mp).
