MEDAN, INVOCAVIT.COM – PT Agung Bumi Lestari ( ABL), yang berlokasi di Desa Pelanggiran Kabupaten Batubara, Andrian Suwito selaku Direktur Utama( Dirut) PT ABL yang beralamat di Jalan Siantan Parit Indah Kecamatan Bukit Raya Pekanbaru serta Himawan Loka alias Ahui warga Jalan Perpustakaan Medan digugat ke Pengadilan Negeri Medan untuk membayar ganti rugi sebesar Rp 2,6 miliar karena dinilai wanprestasi ( ingkar janji)
” Gugatan itu diajukan Edwin selaku pemilik UD.Naga Sakti Perkasa ( NSP) yang beralamat di Jalan Perniagaan Medan,” ujar Franktino Sitanggang,SH kepada awak media di Medan, Kamis (9/5/2024)
Menurut Sitanggang, Majelis Hakim PN Medan sudah menggelar persidangan perdata itu.Tapi tergugat III Himawan Loka sampai saat ini belum memenuhi panggilan.
Karena itu, pengadilan akan memanggil kembali tergugat III untuk menghadiri persidangan pada pekan mendatang. Sedangkan Tergugat I ( PT ABL) dan Dirutnya sebagai Tergugat II diwakili oleh Kuasa Hukumnya.
Hindari Jual beli aset.
Franktino Sitanggang mengingatkan para tergugat tidak mengalihkan aset perusahaan kepada pihak lain . Sebab seluruh aset para tergugat sudah dimohonkan diletakkan sita jaminan oleh pengadilan
” Selama proses persidangan, penggugat menghimbau para tergugat tidak melakukan transaksi jual beli aset perusahaan karena akan menimbulkan hukum baru,” ujar Franktino Sitanggang mewakili Penggugat Edwin
Dalam gugatan dijelaskan, antara PT ABL dan UD NSP melakukan kerjasama sejak 2014 hingga 2018.
PT ABL melalui General Managernya Himawan Loka melakukan permintaan barang berupa serbet, tissue, tusuk sate dan pipet kepada UD NSP.
Awalnya kerjasama itu berlangsung baik.Tapi tahun 2015 kerjasama itu mulai sedikit terganggu karena hutang PT ABL sebesar Rp 566.189.925 tidak terbayarkan dengan berbagai alasan.
Karena PT ABL tidak berniat membayar hutangnya, akhirnya Edwin mewakili UD NSP melaporkan Himawan Loka ke polisi dengan tuduhan penggelapan.
Franktino Sitanggang, tindakan Himawan Loka tidak terlepas dari Tanggungjawab PT ABL dan Andrian Suwito, karena selama rentang waktu 2014-2018 tergugat 1 dan II tidak melakukan tindakan apapun terhadap Himawan Loka selaku GM PT ABL
Sehingga penggugat patut menduga setiap transaksi yang dilakukan Tergugat III merupakan tanggungjawab Tergugat II dan III
Tentang uang jaminan UD NSP sebesar Rp 366.249.000 ke rekening Andrian Suwito tidak pernah dikembalikan.Jika uang itu dijadikan modal usaha,maka penggugat menerima laba) bunga 12 persen.Jika lima tahun sejak 2018 hingga sekarang berarti yang harus dikembalikan para tergugat Rp 219.744.000+Rp 366.240.000 = Rp 585.984.000.
Sedangkan kerugian immaterial termasuk hilangnya kepercayaan penggugat karena ulah para tergugat, penundaan uang jaminan dan biaya ekstra yang dikeluarkan penggugat.
Karena para tergugat sudah melakukan ingkar janji, maka penggugat berharap Majelis Hakim PN Medan mengabulkan seluruh gugatan penggugat dan meletakkan sita jaminan berupa pabrik Tergugat I di lintas Timur Pasir KM 14 Kecamatan Pasar Baru Pekanbaru.***
