MEDAN, INVOCAVIT.COM – Seorang karyawan perusahaan PT LIXIL yang berpusat di Jakarta diduga menjadi korban diskriminasi.
Setelah hak selama 3 tahun ditaksir hingga mencapai Rp1 miliar tidak dibayar, wanita berinisial AL asal Jakarta yang sedang ditugaskan di Kota Medan tersebut malah di PHK.
Ironinya, diskriminasi pemecatan secara sepihak itu terjadi saat korban dalam keadaan sakit dan izin tidak masuk kerja. Selama 4 tahun ditugaskan ke Medan, AL tidak diberikan tunjangan layaknya karyawan yang sedang perjalanan dinas ke luar kota.
Berulangkali sejak 2020 AL menanyakan haknya, dan setelah menyampaikan akan menuntut secara hukum akhirnya pada Desember 2023 tunjangannya dibayarkan. Namun, yang dibayarkan masih kurang karena hanya 1 tahun, sedangkan sisanya 3 tahun AL masih terus disuruh menunggu.
Ketidaksanggupan perusahaan membayarkan hak AL diduga menjadi awal mula perselisihan hak ini terjadi. Karena terus berjuang meminta haknya dibayar kemungkinan menjadi penyebab perusahaan ingin melakukan PHK sepihak terhadap AL.
“Saya hanya meminta apa yang menjadi hak saya, yang mana juga sudah diatur di peraturan perusahaan untuk setiap perjalanan dinas ada tunjangannya seperti akomodasi, uang saku, transportasi dikota tujuan dan lain-lain. Perusahaan telah memberangkatkan saya ke Medan tapi tidak mau membayar apa yang seharusnya saya dapat selama perjalanan dinas,” tutur AL, Kamis (19/12).
Dia menyebutkan, perusahaan terus menyuruhnya bersabar, namun tidak ada kepastian waktu pembayarannya. Bahkan setelah di PHK sampai saat ini perusahaan tidak ada itikad baik mengembalikannya ke kota asalnya Jakarta.
“Saya sudah rela meninggalkan keluarga saya di Jakarta untuk ditugaskan ke Medan. Saya single parent memiliki anak balita, saya juga telah memberi kontribusi penjualan selama di Medan sebesar Rp45 miliar. Penugasan ini demi kepentingan perusahaan tapi saya harus menanggung biaya selama penugasan dengan uang pribadi saya sendiri. Ini tidak adil bagi saya, perusahaan semena-mena terhadap saya,” sebutnya.
“Sudahlah tidak ada pesangon, tidak ada juga pihak perusahaan yang menghubungi saya mengenai pemulangan saya ke Jakarta, saya hanya nerima surat PHK melalui WhatsApp (WA),” kesal AL seraya menuturkan perusahaan tempatnya merupakan perusahaan asing asal Jepang yang dikenal dengan product sanitary brand American Standard dan Grohe.
Sementara, kuasa hukum AL, Hardi Saputra Purba, menyebutkan PHK ini jelas batal demi hukum, karena Undang-undang (UU) Cipta Kerja melarang pengusaha melakukan pemutusan hubungan kerja terhadap karyawan yang sedang sakit.
“Apalagi, dalam surat PHK disebutkan klien kami ini mangkir. Ini sudah terbantahkan dengan adanya surat keterangan sakit, ada juga bukti komunikasi yang intens antara keluarga AL dengan perusahaan mengenai ketidakhadirannya,” terangnya.
Hardi menilai, HRD perusahaan AL memang sangat diskriminasi. Seharusnya, perlakukan karyawan sebagai manusia yang ada kalanya sakit. Padahal, AL sudah mengirimkan surat keterangan sakit dari rumah sakit resmi, tapi HRD perusahaan meminta kliennya hadir zoom meeting.
“Ketika si klien kami tidak hadir karena memang sedang dirawat sakit, HRD malah mengatakan, ‘separah apa sakitnya sampai tidak bisa zoom’. Bahasa inikan nggak pantas dikatakan oleh seorang human resources terlihat tidak memiliki empati. Semua jelas ada bukti-bukti email. Jangan main-main perusahaan, selain melanggar UU cipta kerja kalian juga melanggar HAM,” tegas Hardi.
Menurutnya, pihaknya sudah melakukan upaya penyelesaian perselisihan hubungan industrial ini pertama Bipartit tidak terjadi mufakat. Kuasa perusahaan dinilai hanya mengulur waktu saja.
“Selanjutkan, kedua kami sudah menjalani penyelesaian perselisihan Tripartit di Disnaker Jakarta Selatan dan hasil anjuran juga sudah ada. Alhamdulillah seluruhnya memihak kepada klien kami, Disnaker mempertimbangkan dengan seksama. Perusahaan dianjurkan untuk membayar seluruh hak klien kami dan mempekerjakan klien kami kembali,” ungkap Hardi.
Karena itu, Hardi mengimbau kepada PT LIXIL untuk menghormati dan menjalani prosedur hukum sebagaimana mestinya. Jika sudah ada anjuran dibayarkanlah, jika masih menolak silahkan menempuh penyelesaian perselisihan hubungan industrial ini di pengadilan.
“Mari kita selesaikan, jangan diam saja. Sudah 1 tahun sejak di PHK klien kami statusnya menggantung tanpa gaji, bagaimana dia menghidupi keluarga dan anaknya?” kecamnya.
“Jika tidak ada respon positif dan itikad baik dari PT LIXIL maka kami akan segera mendaftar gugatan PHI ini ke pengadilan, karena ini sudah akhir tahun. Awal Januari pasti kami gugat,” tegas Hardi.
Terpisah, Presiden Direktur PT LIXIL, Santa Firmansyah, ketika hendak dikonfirmasi tentang dugaan PHK sepihak terhadap AL itu enggan memberikan jawaban.
