Majelis hakim diketuai Sayed Tarmizi saat membacakan putusan terdakwa Mulya Chandra (ist)
INVOCAVIT.COM, MEDAN – Majelis hakim Pengadilan Negeri Medan diketuai Sayed Tarmizi memvonis bebas ( vrijspraak) terdakwa Mulya Chandra alias Mul (44) warga Jalan Pancing V, Medan Labuhan. Hakim menilai Mulyadi tidak terbukti bersalah atas kepemilikan sabu seberat 0,07 gram, Selasa (14/3/2023).
Hakim tak sependapat dengan Rahmayani Amir, Jaksa Penuntut Umum (JPU) dari Kejari Medan, yang semula menuntut terdakwa selama 6 tahun penjara, denda Rp1 miliar, subsider 6 bulan penjara.
“Membebaskan terdakwa Mulya Chandra alias Mul dari dakwaan penuntut umum dan memerintahkan penuntut umum mengeluarkan terdakwa dari tahanan, memulihkan harkat dan martabatnya,” tegas hakim, dalam sidang virtual di Ruang Cakra 3.
Hakim menilai terdakwa tidak terbukti bersalah sebagaimana dakwaan JPU Pasal 114 dan 112 ayat (1) UU RI No 35 tahun 2009 tentang Narkotika.
Dua saksi yang dihadirkan terdakwa yakni Ngatemi dan Anisah Jamalia selaku ibu dan saudara terdakwa membantah dalil Jaksa bahwa terdakwa menjual sabu kepada seorang polisi yang menangkapnya.” Tidak ada transaksi dan penangkapan tanggal 21 September 2022.Tapi yang ada 4 polisi masuk ke rumah terdakwa pada pukul 21 September 2022 pukul 11.00 wib,” ujar Hakim Sayeed mengutip keterangan dua saksi yang meringankan.
Menurut hakim, dua saksi itu menerangkan sehabis terdakwa pulang bekerja sebagai sopir travel mendadak 4 polisi menyergap rumah ibu terdakwa dan terdakwa itu membantah sabu seberat 0,07 gram itu miliknya.
Selain itu, undercover buy ( penyamaran polisi) untuk menangkap terdakwa itu dinilai tidak sah karena tidak melalui seizin atasannya.” Kalau polisi di lapangan bisa melakukan undercover buy tanpa izin atasan bisa meresahkan masyarakat,” kata hakim.
Selain itu polisi yang menangkap tidak menunjukkan surat perintah penangkapan dan penggeledahan,” lanjut hakim.
Atas putusan hakim tersebut, terdakwa dan JPU diberi waktu 7 hari untuk mengajukan proses hukum selanjutnya.
Diketahui, pada 21 September 2022, tiga anggota Polrestabes Medan mendapat informasi adanya peredaran narkotika jenis sabu di Jalan Banten Gang Amal Kelurahan Helvetia, Kecamatan Medan Helvetia.
Mendapat informasi tersebut, polisi langsung melakukan penyelidikan dengan menghampiri terdakwa dan mengatakan akan membeli sabu. Lalu ketika terdakwa akan menyerahkan 1 bungkus plastik klip berisi sabu, langsung mengamankan terdakwa dan barang bukti sabu seberat 0,07 gram.
Dari tangan sebelah kanan terdakwa ditemukan uang sebesar Rp112.000, dari saku terdakwa. Saat di introgasi, terdakwa mengakui bahwa sabu diperoleh dari Ijul (DPO) yang akan diperjualbelikan terdakwa. Dan uang sebesar Rp112.000, adalah uang hasil penjualan. (Pung).
