Invocavit.com, Stabat – Sidang perkara nomor 467/Pid.B/2022/PN Stb kembali digelar, Selasa (18/10/2022) siang. Dari Rutan Kelas IIA Tanjung Gusta Medan, terdakwa DP dan HS mengikuti sidang itu secara virtual. Agendanya, untuk mendengarkan keterangan saksi yang meringankan (A De Charge) Sehmalem Tabana Sembiring.
Dalam sidang yang digelar di ruang Prof Dr Kusumah Admadja SH itu, saksi menerangkan, bahwa almarhum Sarianto Ginting kerap mencuri uang adiknya. Bahkan, Sarianto pernah meinta uang kepada ibunya sambil menghunuskan parang.
Tiga kali ditolak
Hal itu dilakukan Sarianto untuk membeli narkoba. Atas dasar keresahan itu lah, keluarga Sarianto kemudian berinisiatif untuk direhab. Kemudian keluarganya meminta bantuan saksi, agar Sarianto dapat dibina di Panti Rehab di Raja Tengah, Kuala.
“Tiga kali dia (Sariandi – adik Sarianto) datang ke rumah saya sama kakeknya. Di luar pun, sudah banyak hutang abangnya. Dia (Sarianto) sering mencuri duit di bengkel abangnya,” terang saksi di persinganan yang dipimpin Halida Rahardhini SH MHum itu.
Waktu minta tolong pertama kali untuk merehab Sarianto, saksi belum memenuhi permintaan keluarganya. Sebelum keluarga Sarianto menemui saksi, mereka pernah datang ke panti rehab di Kuala, tapi tidak diterima.
Tidak sehat dan lemas
Setalah kali ke tiga keluarga Sarianto minta tolong, akhirnya saksi mau membantunya. Tapi saat itu masih diupayakan oleh saksi. Keesokan harinya, saksi dan kakek serta Sariandi pergi ke panti rehab.
Akhirnya, Sarianto diterima oleh Uci untuk direhab di sana. Kemudian, keluarga Sarianto menandatangani surat pernyataan sebelum Sarianto direhab. Besoknya, Sarianto dijemput dari rumahnya untuk dibawa ke panti rehab.
Saksi menyebutkan, dia pernah ikut keluarga Sarianto ke panti rehab untuk mengantar pakaian. Di sana lah saksi bertemu dengan Sarianto untuk pertama kalinya. Saat itu, Sarianto terlihat tidak sehat dan lemas. Bahkan, saksi mengetahui kalau sarianto sering mengkonsumsi obat untuk kesehatannya.
Sementara, Ketua Majelis Hakim Halida Rahardhini SH MHum mengatakan, bahwa keterangan Sehmalem dengan keterangan saksi sebelumnya (adik Sarianto) berbeda. Padahal, Sariandi dalam kesaksiannya tidak ada melihat Sarianto saat mengantar pakaian ke panti rehab.
“Berdasarkan keterangan adik kandung korban saat memberikan kesaksian, dia tidak masuk atau tidak berjumpa langsung dengan korban Sarianto Ginting. Pakaian milik Sarianto saat itu dititipkan kepada penjaga panti rehab,” jelas Halida.
Mengikhlaskan kematian Sarianto
Usai pemeriksaan saksi A De Charge itu, Halida memutuskan melanjutkan persidangan, Rabu (26/10/2022) mendatang. Agendanya, pembacaan tuntutan JPU sekaligus tuntutan perkara 468/Pid.B/2022/PN Stb dan 469/Pid.B/2022/PN Stb, dengan terdakwa HS, IS, TU, JS, SP dan RG.
Usai persidangan, Poltak A Sianaga, penasihat hukum (PH) para terdakwa menyampaikan, bahwa Sarianto Ginting sudah lama sakit. Selain itu, Sarianto juga berulang kali berusaha untuk bunuh diri dan sering direhab.
“Di persidangan tadi, saksi menyebutkan sudah mengikhlaskan kematian Sarianto. Saat dibina di panti rehab Kuala, keluarga Sarianto merasa senang dan lega,” kata Poltak.
Selama ini, lanjut Poltak, keluarga Sarianto juga cukup resah. Karena, sering mencuri uang di bengkel adiknya dan meminta uang kepada ibunya dengan mengacam menggunakan golok. (Ahmad)
