Ketiga tersangka korupsi pembangunan IPAL ditahan Jaksa( pung)
MEDAN, INVOCAVIT.COM – Jaksa Penuntut Umum ( JPU) Bidang Tindak Pidana Khusus ( Pidsus) Kejaksaan Negeri Padangsidimpuan menahan tiga tersangka korupsi pembangunan Instalasi Pembuangan Air Limbah (IPAL) domestik kota Padangsidimpuan Tahun Anggaran( TA) 2020 ke Rutan Tanjung Gusta Medan, Senin (19/2/2024)
” Penahanan ketiga tersangka BS selaku Pengguna Anggaran( PA) dan Pejabat Pembuat Komitmen (PPK) yang juga mantan Kadis Lingkungan Hidup(LH) Sumut, FP selaku Direktur CV. Satahi Persada sebagai Penyedia dan DS selaku Direktur CV. Sportif Citra Mandiri sebagai Konsultan Pengawas setelah Penuntut Umum menerima tahap berkas dan 3 tersangka dari penyidik Pidsus Kejari Padang Sidimpuan di kantor Kejati Sumut,” ujar Kepala Kejaksaan Negeri Padangsidimpuan Dr.Lambok MJ Sidabutar,SH MH didampingi Kasi Pidsus Elan Jaelani,SH dan Kasi Intelijen Yunus Zega,SH MH menjawab awak media di kantor Kejati Sumut, Senin (19/2/2024) siang.
Setelah pemeriksaan kesehatan dan dinyatakan sehat oleh dokter di Poliklinik Kejaksaan Tinggi Sumatera Utara, ketiga tersangka langsung dilakukan penahanan. Penahanan ketiga tersangka tersebut untuk 20 hari kedepan terhitung Senin (19/2/2024).
Diketahui, ketiga tersangka itu selama penyidikan tidak dilakukan penahanan.Namun setelah tahap II baru dilakukan penahanan untuk mempercepat penuntutan.
” Kita rencanakan Selasa (20/2/2024) berkas ketiga tersangka itu akan dilimpahkan ke Pengadilan Tipikor Medan,” ujar Lambok Sidabutar.
Menurut Lambok, ketiga tersangka terlibat dugaan tindak pidana korupsi dalam Kegiatan Belanja Barang kepada Masyarakat Pembangunan Ipal Domestik di Kota Padangsidimpuan TA. 2020 yang berlokasi di Sekolah Islam Terpadu Darul Hasan yang beralamat di Jalan Ompu Huta Tunjul Hutaimbaru Kota Padangsidimpuan.
Ternyata, dalam pekerjaan tersebut para tersangka tidakmelaksanakan kewajibannya sebagaimana yang tertera didalam kontrak yaitu pekerjaan tidak sesuai dengan spesifikasi yang tertera dalam Kontrak dengan kondisi Barang/Jasa yang telah
dikerjakan sehingga terdapat kekurangan volume dan Instalasi Pembuangan Air Limbah (IPAL) tersebut tidak berfungsi sesuai dengan Laporan Pemeriksaan Ahli Konstruksi Nomor : 011/LP/IX/2022/VGS yang mengakibatkan kerugian keuangan negara sebesar Rp. 540.601.214,-berdasarkan Laporan Hasil Perhitungan Kerugian Negara dari Kantor Akuntan Publik Nomor : 0000/2.1349/AL/0287/1/IX/2023 tanggal 12 September 2023.
Dijelaskannya, pada saat dilakukan penelitian, para tersangka mengakui perbuatannya dan hal tersebut telah dituangkan dalam Berita Acara Penerimaan dan Penelitian Tersangka (BA-4).
Para tersangka dijerat melanggar pasal 3 dan 2 ayat (1) Jo. pasal 18 ayat (1) huruf b Undang-Undang RI Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang RI Nomor 20 Tahun 2001 tentang perubahan atas Undang-Undang RI Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi Jo. pasal 18 ayat (1) Ke-1 KUHPidana Jo. pasal 55 ayat (1) Ke-1 KUHPidana.
