Setahun Tak Ada Kepastian Hukum, Denpom I/5 Medan Diduga Lindungi Kopral Mirwansah, PH Dilarang Door Stop

Tim kuasa hukum ESG, Thomas Tarigan SH.MH dan Suhandri Umar SH.MH saat memberika keterangan kepada wartawan dilarang anggota Denpom I/5 Medan, Selasa (1/7).(jos Tambunan).
MEDAN, INVOCAVIT.COM: Tim kuasa hukum Edi Suranta Gurusinga kembali mendatangi kantor Denpom I/5 Medan di Jalan Suprapto, Medan, Selasa (1/7/2025) siang.
Kedatangan tiga orang pengacara ini, diantaranya Thomas Tarigan SH MH, Ronald Siahaan SH MH dan Suhandri Umar SH untuk mempertanyakan  tindaklanjuti laporan terhadap Kopral Mirwansyah terduga pemilik senjata api merek Daewo buatan korea yang diamankan oleh Brimob Polda Sumut, yang sudah disampaikan pada Senin 8 April 2024.
Bahkan, tim kuasa hukum ESG sudah menanyakan langsung kepada Pangdam I/BB dan berjanji akan menyampaikan semua jika sudah ada putusan dari Pengadilan Negeri. Tapi, kendati hakim telah memutuskan bahwa ESG tidak bersalah dan memberi vonis bebas namun sampai saat ini janji Pangdam tidak direalisasikan.
“Artinya, hari ini kami atas nama klien kami, Edi Suranta Gurusinga meminta agar Denpom I/5 Medan ini menindaklanjuti laporan kami. Sudah satu tahun lebih laporan kami belum ada kepastian hukum,” kata Thomas Tarigan SH MH.
Akan tetapi, sampai di Denpom I/5 Medan. Mereka tidak kunjung mendapatkan kepastian dari kasus itu.
“Kami minta surat perkembangan kasus juga tidak ada. Minta surat keterangan kasus tidak ada juga,  kami juga butuh penjelasan dari Denpom apakah terlapor yaitu Kopral Mirwansyah sudah diperiksa, saksi pengadu sudah diperiksa, dan bahkan apakah terlapor atau teradu ini pernah ditahan atau ditempatkan di tempat khusus (patsus) atau tidak. Itu yang kami tidak dapatkan sampai saat ini,” tutur Thomas.
Bukan itu saja, pengacara ini juga kecewa atas penyelidikan dan atau penyidikan yang dilakukan oleh tim Denpom I/5 Medan yang diduga tidak transparan dan tidak pernah memberikan hasil penyelidikan yang dilakukan kepada pelapor atau kuasa hukumnya.
Ironisnya, pengacara juga sempat dilarang untuk menggelar konferensi pers didepan atau diluar gedung kantor Denpom I/5 Medan.
Beberapa personil Dari Denpom 1/5 Medan yang salah satunya bernama Serda Zerry melarang pengacara melakukan gelar Konfrensi Pers di luar gedung Denpom 1/5 Medan, aksi inipun sepontan mendapat perlawanan dari tim penasehat hukum pelapor Thomas Tarigan.
“Ini ruang publik, diluar kantor Denpom I/5 Medan. Kami juga tahu aturan, tidak perlu anda melarang kami. Anda-anda ini sudah berapa lama tugas disini. Kami sudah bolak-balik datang ke sini. Kami kasih keterangan kepada wartawan ditempat ini karena ada kaitannya dengan perkara yang Denpom I/5 Medan tangani yang sampai saat ini sudah hampir satu tahun tidak jelas juntrungannya,” tegas Thomas Tarigan.
Namun, anggota Denpom I/5 Medan, Serda Zerry terus ngotot.”Aturan kami disini tidak bisa poto-poto atau video. Kami nanti ditegur pimpinan,” katanya. Tak ingin ribut, tim kuasa hukum ESG itupun dengan kecewa meninggalkan lokasi.
“Lambatnya proses penyelidikan dan penyidikan ini akan kami Surati bapak Panglima Kodam I Bukit Barisan. Kami juga meminta surat keterangan proses penanganan yang telah dilakukan oleh tim Denpom I/5 Medan,” tegasnya.
Sebelumnya, Kopral M diduga diamankan Brimob Polda Sumut di Jalan Polo Sari, Desa Durin Jangak, Kecamatan Pancur Batu, Selasa (13/3/24) malam.
Selanjutnya tim Brimob juga menemukan senjata api diseputaran lokasi. Namun, pihak Brimob Polda Sumut diduga membalikkan fakta bahwa senjata api itu milik Edi Suranta Gurusinga dan akhirnya perkara senjata itu sampai ke Pengadilan Negeri Lubuk Pakam.
Akan tetapi, Pengadilan Negeri Lubuk Pakam yang dipimpin ketua majelis Simin CP Sitorus akhirnya memvonis bebas Edi Suranta atas status terdakwa dugaan kepemilikan senjata api (senpi) ilegal pada Selasa (13/8/2024).
“Mengadili, menyatakan terdakwa Edi Suranta Gurusinga alias Godol tidak terbukti secara sah dan menyakinkan, melakukan tindak pidana sebagaimana didakwakan oleh JPU atas kepemilikan senjata api,” kata Simon CP Sitorus saat itu.
 “Kedua, membebaskan terdakwa dari dakwaan tersebut. Tiga, memerintahkan terdakwa dibebaskan dari tahanan. Empat, mengembalikan harkat dan martabat,” jelas Simon dalam putusannya.(jos)
