INVOCAVIT.COM – Sebelum membahas hukuman mati, Pasal 10 KUHP mengatur terkait 5 jenis pidana pokok yang bisa dijatuhkan pada pelaku tindak pidana, seperti pidana mati, pidana penjara, pidana kurungan, pidana denda dan pidana tutupan.
Pidana mati adalah salah satu dari jenis pidana yang pengaturanya ada di dalam Kitab Undang-Undang Hukum Pidana, yang mana termasuk jenis pidana pokok yang terberat.
Di dalam Kitab Undang-Undang Hukum Pidana pengaturan terkait pidana mati hanya diatur dalam Pasal 11 yang berbunyi:
“Pidana mati dijalankan oleh algojo di tempat gantungan dengan menjeratkan tali pada leher terpidana, dan mengikatkan tali itu pada tiang gantungan, kemudian menjatuhkan papan tempat terpidana berdiri”.
Sebelum diatur di dalam KUHP aturan terkait pelaksanaan pidana mati di Indonesia telah beberapa kali diubah, yaitu menurut WvS 1915 dilakukan dengan cara digantung, menurut Osamu Gunrei Nomor 1 tanggal 2 Maret 1942 dilakukan dengan cara ditembak mati, menurut WvS 1915 juncto Staatsblad 1945 Nomor 123 dilakukan dengan cara ditembak mati.
Ketentuan Pasal 11 KUHP diubah oleh Undang-Undang Nomor 02/Pnps/1964 juncto Undang-Undang Nomor 5 Tahun 1969 Tentang Tata Cara Pelaksanaan Pidana Mati yang Dijatuhkan oleh Pengadilan di Lingkungan Pengadilan Umum dan Militer.
Kemudian pemerintah membuat pengaturan yang lebih teknis terkait pelaksanaan pidana mati yang mana diatur dalam Peraturan Kapolri No. 12 Tahun 2010 tentang Tata Cara Pelaksanaan Pidana Mati.
Tata Cara Pelaksanaan Pidana Mati
Tata cara pelaksanaan pidana mati terbagi menjadi 4 tahap yaitu: persiapan, pengorganisasian, pelaksanaan, dan pengakhiran.
Pertama
Terpidana diberikan pakaian yang bersih, sederhana, dan berwarna putih sebelum dibawa ke tempat pelaksanaan pidana mati.
Pada saat dibawa ke tempat pelaksanaan pidana mati terpidana dapat didampingi oleh seorang rohaniawan. Regu pendukung telah siap di tempat yang telah ditentukan 2 jam sebelum waktu pelaksanaan pidana mati.
Regu penembak telah siap di lokasi pelaksanaan pidana mati 1 jam sebelum pelaksanaan dan berkumpul di daerah persiapan.
Regu penembak mengatur posisi dan meletakkan 12 pucuk senjata api laras panjang di depan posisi tiang pelaksanaan pidana mati pada jarak 5 meter sampai dengan 10 meter dan kembali ke daerah persiapan.
Kedua
Jaksa Eksekutor mengadakan pemeriksaan terakhir terhadap terpidana mati dan persenjataan yang akan digunakan.
Atas perintah dari Jaksa Eksekutor, Komandan Pelaksana memerintahkan Komandan Regu penembak untuk mengisi amunisi dan mengunci senjata ke dalam 12 pucuk senjata api laras panjang dengan 3 butir peluru tajam dan 9 butir peluru hampa yang masing-masing senjata api berisi 1 butir peluru.
Jaksa Eksekutor memerintahkan Komandan Regu 2 bersama anggotanya untuk membawa terpidana ke posisi penembakan dan melepaskan borgol lalu mengikat kedua tangan dan kaki terpidana ke tiang penyangga pelaksanaan pidana mati dengan posisi berdiri, duduk, atau berlutut, kecuali ditentukan lain oleh Jaksa.
Ketiga
Terpidana diberi kesempatan terakhir untuk menenangkan diri paling lama 3 menit dengan didampingi seorang rohaniawan. Komandan Regu 2 menutup mata terpidana dengan kain hitam, kecuali jika terpidana menolak.
Dokter memberi tanda berwarna hitam pada baju terpidana tepat pada posisi jantung sebagai sasaran penembakan; Komandan Regu 2 melaporkan kepada Jaksa Eksekutor bahwa terpidana telah siap untuk dilaksanakan pidana mati.
Keempat
Jaksa Eksekutor memberikan tanda/isyarat kepada Komandan Pelaksana untuk segera dilaksanakan penembakan terhadap terpidana.
Komandan Pelaksana memberikan tanda/isyarat kepada Komandan Regu penembak untuk membawa regu penembak mengambil posisi dan mengambil senjata dengan posisi depan senjata dan menghadap ke arah terpidana.
Komandan Pelaksana mengambil tempat di samping kanan depan regu penembak dengan menghadap ke arah serong kiri regu penembak dan mengambil sikap istirahat di tempat.
Pada saat Komandan Pelaksana mengambil sikap sempurna regu penembak mengambil sikap salvo ke atas. Komandan Pelaksana menghunus pedang sebagai isyarat bagi regu penembak untuk membidik sasaran ke arah jantung terpidana.
Komandan Pelaksana mengacungkan pedang ke depan setinggi dagu sebagai isyarat kepada Regu penembak untuk membuka kunci senjata. Komandan Pelaksana menghentakkan pedang ke bawah pada posisi hormat pedang sebagai isyarat kepada regu penembak untuk melakukan penembakan secara serentak.
Kelima
Setelah penembakan selesai Komandan Pelaksana menyarungkan pedang sebagai isyarat kepada regu penembak mengambil sikap depan senjata.
Komandan Pelaksana, Jaksa Eksekutor, dan Dokter memeriksa kondisi terpidana dan apabila menurut Dokter terpidana masih menunjukkan tanda-tanda kehidupan.
Jaksa Eksekutor memerintahkan Komandan Pelaksana melakukan penembakan pengakhir. Komandan Pelaksana memerintahkan komandan regu penembak untuk melakukan penembakan pengakhir dengan menempelkan ujung laras senjata genggam pada pelipis terpidana tepat di atas telinga.
Penembakan pengakhir ini dapat diulangi, apabila menurut keterangan Dokter masih ada tanda-tanda kehidupan. Pelaksanaan pidana mati dinyatakan selesai, apabila dokter sudah menyatakan bahwa tidak ada lagi tanda-tanda kehidupan pada terpidana.(ak).
