Dirtipidum Bareskrim Polri: Kuasa Hukum Brigadir J Tidak Wajib  Ikuti Rekonstruksi

INVOCAVIT.COM, JAKARTA- Direktur Tindak Pidana Umum Bareskrim Polri, Brigjen Pol Andi Rian Djajadi angkat bicara mengenai protes pengacara keluarga Brigadir J, Kamaruddin Simanjuntak dan Jhonson Panjaitan yang mengaku diusir dari lokasi rekonstruksi pembunuhan di rumah pribadi Irjen Ferdy Sambo, di Jalan Saguling III, Jakarta Selatan.

 

Saat dikonfirmasi, Brigjen Andi menegaskan segala proses rekonstruksi pembunuhan Brigadir J ini hanya wajib dihadiri oleh pihak-pihak seperti penyidik, jaksa penuntut umum (JPU), kelima tersangka hingga kuasa hukumnya.

 

“Yang wajib hadir dalam proses reka ulang atau rekonstruksi adalah penyidik, JPU, para tersangka dan saksi beserta kuasa hukumnya,” ungkap Andi saat dikonfirmasi wartawan, Selasa, (30/8/2022).

 

Andi menegaskan, tidak ada ketentuan atau kewajiban dari pihaknya untuk mengizinkan pihak lain masuk dan menyaksikan proses rekonstruksi tersebut. Termasuk dengan kuasa hukum Brigadir J, Kamaruddin Simanjuntak selaku perwakilan korban.

 

“Rekonstruksi atau reka ulang ini untuk kepentingan penyidikan dan penuntutan. Dihadiri para tersangka, saksi beserta kuasa hukumnya. Proses reka ulang diawasi oleh Kompolnas, Komnas HAM, dan LPSK. Jadi tidak ada ketentuan proses reka ulang atau rekonstruksi wajib menghadirkan korban yang sudah meninggal atau kuasa hukumnya,” tandasnya.

 

Sebelumnya, pengacara keluarga Brigadir Yoshua, Kamaruddin Simanjuntak dan Jhonson Panjaitan mendatangi rumah pribadi Irjen Ferdy Sambo tempat rekonstruksi pembunuhan berencana Brigadir J berlangsung, hari ini, Selasa 30 Agustus 2022.

 

Kamaruddin mengatakan, sejak pukul 08.00 WIB pagi, dirinya telah bersiap mengikuti proses rekonstruksi. Namun, setelah menunggu, pihaknya tidak dibiarkan masuk oleh pihak tertentu.

 

“Kami sudah datang pagi pagi bahkan jam 8 sudah di sini, ternyata kami sudah disini menunggu yang boleh ikut rekonstruksi hanya penyidik. Kemudian tersangka, kemudian pengacara tersangka LPSK, Komnas HAM, Brimob dan sebagainya,” ujar Kamaruddin di jalan Saguling III, Pancoran, Jakarta.

 

Lebih lanjut, Kamaruddin juga menuturkan, pelarangan tersebut merupakan pelanggaran hukum. Karena, kata Kamaruddin Ia memiliki kuasa sebagai salah satu pelapor.

 

“Sementara kami dari Pelapor tak boleh lihat. Ini Bagi kami suatu pelanggaran hukum yang sangat berat, tidak ada makna dari equality before the law, entah apa yang dilakukan didalam kami juga gak tahu,” ucap Kamaruddin.

 

Adapun rekonstruksi kasus pembunuhan berencana Brigadir J ini dilakukan di dua lokasi yakni rumah pribadi Ferdy Sambo di Jalan Saguling III dan di lokasi pembunuhan di rumah dinas Ferdy Sambo di Kompleks Polri, Duren Tiga, Jakarta Selatan.

 

Rekonstruksi ini berlangsung secara tertutup dan Polri menyediakan TV untuk para awak media dapat menyaksikannya. Sebanyak 78 adegan rencananya akan diperagakan dalam rekonstruksi ini.***
