Terdakwa TPPO Dituntut JPU 8 Tahun Penjara, PH : Tidak Masuk Akal

Invocavit, Stabat – Jaksa penuntut umum (JPU) menuntut 8 tahun pejara terhap 4 orang terdakwa tindak pidana perdagangan orang (TPPO). Penasihat hukum (PH) terdakwa menilai, tuntutan yang diberikan JPU itu terkesan gila dan tidak masuk akal. Pasalnya, TU, JS, SP dan RG hanya dituntut dengan dalil melakukan perekrutan dan eksploitasi terhadap penghuni panti rehab.

Tuntutan itu dibacakan JPU dalam persidangan yang digelar di Ruang Cakra PN Stabat, Selasa (22/11/2022) siang. Sementara, para terdakwa mengikutinya secara virtual, dari Rutan Kelas IIA Tanjung Gusta Medan. Sidang TPPO dengan register perkara nomor 469/Pid.B/2022/PN.Stb itu, dipimpin Ketua Majelis Hakim Halida Rahardhini SH MH.

 

Delapan tahun penjara

 

Di hadapan majelis hakim dan PH, JPU yang dipimpin Indra Ahmadi Efendi SH menngatakan, para terdakwa terbukti secara sah dan meyakinkan melakukan tindak pidana dimaksud.

 

“Menjatuhkan pidana oleh karena itu, dengan pidana penjara masing – masing selama 8 tahun dan denda sebesar Rp200 juta, subsider 3 bulan kurungan. Dikurangi masa penangkapan dan penahanan yang telah dijalanipara terdakwa,” ucap Baron Sidik, membacakan nota tuntutannya.

 

Selain itu, barang bukti yang terlampir dalam perkara tersebut, akan digunakan dalam pembuktian perkara atas nama saksi Terbit Rencana PA (TRP). Para terdakwa dituntut sesuai dengan Pasal 10 UU No 21 Tahun 2007 tentang pemberantasan TPPO.

 

Dimana menurut JPU, para terdakwa telah melakukan percobaan menerima seseorang dengan ancaman kekerasan untuk mengeksploitasi korban. Meskipun hal itu mendapatkan persetujuan dari orang yang melakukannya atas orang lain.

Usai pembacaan tuntutan itu, Halida kemudian mengakhiri persidangan, dan akan dilanjutkan, Kamis (24/11/2022) mendatang, dengan agenda pembelaan (pledoi) dari para terdakwa. Nantinya, pledoi itu akan disampaikan PH para terdakwa secara tertulis.

 

Dinilai gila dan tidak masuk akal

 

Terpisah, Mangapul Silalahi dan Poltak A Sinaga, PH para terdakwa menilai, tuntutan JPU itu terkesan tidak masuk akal. “Ini tuntutan yang gila dan tidak masuk akal. Sejak awal kami berkeyakinan, tidak ada niat para terdakwa melakukan apa yang dituduhkan,” tegas Mangapul.

 

Dalam dakwaan kumulatif, kata Mangapul, JPU dalam tuntutannya hanya mendalilkan Pasal 10 UU No 21 tahun 2007 tentang TPPO. Dimana, pada pasal itu terkait tentang perekrutan dan eksploitasi manusia.

 

Sementara pada fakta di persidangan, tidak ada perekrutan yang terjadi seperti dakwaan dan tuntutan JPU. Justru, hal itu atas kemaun orang tua, keluarga atau korban sendiri.

 

Terkait dipekerjakannya penghuni panti rehab, menurut Mangapul merupakan upaya pembinaan bagi pecandu narkoba di sana. Agar para warga binaan bisa lupa atas ketergantungannya mengkonsumsi barang haram itu.

 

Didirikan organisasi PP

 

“Yang harus dicatat, peran mereka (terdakwa) mengambil alih fungsi negara. Hal yang mereka lakukan sebagai bagian dari hal yang pernah mereka dapatkan sebelumnya, untuk pulih dari kecanduan narkoba,” terang Mangapul.

 

Poltak juga menjelaskan, kerangnkeng di panti rehab dekat kediaman TRP untuk menyembuhkan pecandu narkoba. Tempat pembinaan itu didirikan organisasi Pemuda Pancasila (PP) atas keresahan warga sekitar terkait maraknya peredaran dan penyalahgunaan barang haram itu.

 

“Fakta persidangan, banyak yang sembuh dan banyak yang berterima kasih kepada panti rehab. Para penghuni panti rehab tidak ada yang mereka (terdakwa) rekrut sendiri. Semua diantar orang tua dan sudah sangat meresahkan,” tegas Poltak.

Sebelumnya, para terdakwa didakwa dengan Pasal 7 ayat 1 UU No 21 Tahun 2007 tentang Pemberantasan Tindak Pidana Perdagangan Orang Jo Pasal 55 ayat (1) ke-1 KUHP, atau Pasal 7 ayat (2) UU TPPO jo Pasal 55 ayat (1) ke-1 KUHP. (Ahmad)
