Dua Terdakwa Korupsi Pengadaan Makanan  WBS Divonis Bebas, JPU Kasasi

INVOCAVIT.COM, MEDAN- Dua terdakwa  korupsi pengadaan makanan dan minuman untuk Warga Binaan Sosial (WBS) senilai Rp875 juta lebih, divonis bebas( vrijspraak) oleh majelis hakim Pengadilan Tipikor Medan yang diketuai Yusafrihardi Girsang, Senin (10/10/2022).

Kedua terdakwa yang dibebaskan itu yakni, Kepala UPT Pelayanan Sosial Eks Kusta Dinas Sosial Belidahan-Sicanang Christina Purba (60), dan Terdakwa Andreas Sihite selaku Direktur CV Gideon Sakti.

Dalam persidangan yang digelar di Ruang Cakra 9, majelis hakim berpendapat bahwa kedua terdakwa tidak terbukti melakukan tindak pidana korupsi sebagaimana dakwaan jaksa penuntut.

“Memerintahkan JPU mengeluarkan kedua terdakwa dari rumah tahanan serta mengembalikan harkat dan martabat terdakwa dalam kemampuannya,harkat dan martabat mereka,” kata hakim mengutip sebait amar putusannya.

Atas putusan itu, Jaksa Penuntut Umum (JPU) Aisyah akan mengajukan kasasi.

Dalam surat tuntutan yang dibacakan JPU Aisyah pada sidang sebelumnya, menuntut kedua terdakwa masing-masing agar dipidana 8 tahun penjara dan denda Rp250 juta dengan subsider 6 bulan kurungan.

Menurut jaksa, kedua terdakwa dinilai telah memenuhi unsur melakukan tindak pidana Pasal 2 Ayat 1 jo Pasal 18 UU  No 20 Tahun 2001 perubahan atas UU No 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi jo Pasal 55 Ayat 1 Ke-1 KUHPidana.

JPU mengatakan terdakwa Christina Br Purba selaku Kuasa Pengguna Anggaran (KPA) dan Andreas Sihite selaku rekanan mengurangi volume pengadaan makanan dan minuman sehingga tidak sesuai isi kontrak.

Kerugian keuangan negara dalam pekerjaan Pengadaan Makan dan Minuman warga binaan Eks Kusta di Sicanang dan Belidahan sebesar Rp875,1 juta akibat pengurangan volume bantuan alias tidak sesuai dengan kontrak di TA 2018 dan 2019. (pung)
